Varley, of Chandlers Way, Grimsargh and formerly of Staining Road, Staining denies murder, manslaughter, two counts of assault by penetration, five counts of cruelty to a child, grievous bodily harm, sexual assault of a child, 13 counts of taking indecent photos or videos of a child, one of distributing an indecent photo of a child, to his co-accused, and one of making an indecent photo.

Describing the baby “as very needy”, Varley a
37-year-old textiles teacher gave detectives his account of the day the youngster passed away.
The jury heard Varley said the day been
“normal” and Preston, who the pair also refer to as Elijah – a name they gave him, was a “happy” little boy.
Atter spending time with his grandmother, Varley described taking Preston home after he was sick on him. He said he put Preston in a bath seat while he jumped in the shower.
Varley said he could see Preston the whole time.
The court heard he left the baby alone for just a few minutes as he went to get himself pyjamas.
As Varley then went back to the bathroom he claims Preston was out of his chair face down in the bath, the jury heard.
He says the baby initially seemed “OK” but
“out of breath”. He said his condition changed when he put a towel around him to take him into the bedroom to put him on the baby changer.
The court heard the baby was sick in the bathroom and in the bedroom, which Varley said he thought was a consequence of swallowing water.
Varley said he was “panicking” as he spent time rubbing his back, and pushing his tummy and chest trying to get up any fluid.

As Varley’s partner John McGowan-Fazakerley, 32, arrived home Varley said he was scared and he shouted out the window for help.
He said he was concerned Preston was not breathing and he ran to let McGowan-Fazakerley into the property leaving the baby on the floor.
The jury heard Varley say he gave Preston
CPR before deciding to drive him to Blackpool Victoria Hospital from their home in Staining Road, Staining instead of waiting for an ambulance.
He said while they were in the car driving he was encouraging the baby by saying “come on baby boy”.
The defendants arrived at A&E around 6.20pm on July 27, 2023.
Medics worked for nearly an hour to resuscitate Preston until a decision was made that further intervention was futile and he was pronounced dead at 7.20pm.
Prosecutors say Varley’s account is inconsistent with post-mortem examination findings, which discovered the child had 40 injuries.
During the four months the baby was placed with the couple as the adoption was processed, prosecutors said baby Preston was allegedly routinely ill-treated, had indecent images and videos taken of him, was sexually abused and physically assaulted.
Preston was born on June 16 2022, immediately taken into care by Oldham Council, and placed with foster parents at five days old.
After undergoing an assessment and familiarisation process in early 2023, he was placed for adoption and began living with the defendants on April 1 at their Staining home.
Varley took a year off work as head of year and as a design and technology teacher at South Shore Academy, to look after the child, but struggled as a new parent with a baby who frequently woke during the night, the court has heard.
